This is a class action brought on behalf of all members of the First Nations who have constitutionally protected aboriginal and/or treaty rights to fish wild salmon for sustenance, food, social and ceremonial purposes within the Broughton Archipelago. The boundaries of the Broughton Archipelago are set out in the map attached to the amended statement of claim which more fully describes this class action.

A certification hearing on the matter took place April 13 – 21, 2010.

Further written submissions were provided by counsel. On December 1, 2010, the matter was certified as a class proceeding.
