This proposed class action alleges the defendants conspired to fix the price of HDD suspension assemblies. HDD suspension assemblies are a necessary component of hard disk drives and are found in products such as external hard disk drives, laptop and desktop computers, computer servers, electronic storage devices that can be accessed remotely, personal video recorders (“PVRs”), and gaming consoles.
On November 9–10, 2023, the Court of Appeal heard the defendants’ appeal of the certification and jurisdiction decisions. On June 24, 2024, the Court of Appeal dismissed the defendants’ appeals. A copy of the Appeal Reasons can be found under Important Documents.
On May 30–31 and June 1–3, 2022, the Supreme Court of British Columbia heard the plaintiffs’ application to certify the within action as a class proceeding and the defendants’ application challenging the Court’s jurisdiction over them. On October 6, 2022, the BC Supreme Court certified the within action as a national class proceeding on behalf of all persons across Canada and dismissed defendants’ jurisdictional challenge. The Class is defined as:
All persons and entities in Canada who purchased one or more products which contained an HDD Suspension Assembly between January 1, 2003, and April 30, 2016 (“Class Period”), including a subclass of all persons and entities in Canada who purchased one or more products that contained an HDD Suspension Assembly in Quebec during the Class Period (“Quebec Subclass”).
On June 24, 2024, the Court of Appeal upheld the Supreme Court of British Columbia’ decision to certify the within action as a national class proceedings.
