This class action alleged that Defendants and their senior executives participated in illegal and secretive meetings and made agreements to fix, maintain, increase, and control the price for the supply of Lithium Ion Rechargeable Batteries and/or enhance unreasonably the prices of Lithium Ion Rechargeable Batteries and to lessen unduly competition in the sale of Lithium Ion Rechargeable Batteries in Canada and elsewhere.
The Claims Deadline of December 17, 2021, has now passed, and no further claims may be filed.
Class Members who filed Undocumented Claims in this class proceeding have now received or will soon receive payment by cheque or Interac e-Transfer.
Cheques were issued April 4, 2022 and will become stale dated after October 4, 2022. Interac e-Transfers were sent in batches commencing on May 2, 2022 and ending May 13, 2022.
Class Members who selected Interac e-Transfer should note that the Interac e-Transfer sender is either: (1) Lithium Batteries Class Action or (2) Computershare Trust Company (the parent company of RicePoint Administration Inc., which is the Claims Administrator).
If you do not have auto deposit set up with your financial institution, you will require a security answer to complete the Interac e-Transfer transaction.
If you filed an Undocumented Claim and have not yet received payment, you should continue to monitor the email you used to register your claim. Deficiency notices will be sent to Class Members whose claims were not approved, and you may be required to take further steps in order to advance your claim.
If you filed a Documented Claim, you will not receive payment at this time. A second distribution to remaining approved Class Members will occur after all Documented Claims have been reviewed and the appeal deadline has passed.

Settlements have been reached with all Defendants totalling approximately CDN $21.3 million. The Ontario and Quebec courts approved a protocol for distributing the net settlement amount. A copy of the Distribution Protocol is available under Important Documents along with copies of the settlement agreements.
