This class action relates to the alleged price fixing of optical disc drives (“ODD”) or products that contained ODD between January 1, 2004 and January 1, 2010. The Third Amended Notice of Civil Claim was filed in the Supreme Court of British Columbia, Vancouver Registry, No. S-106462 on December 6, 2016.
ODD means CD-ROM, CD-R/RW, DVD-ROM, DVD-R/RW, Blu-Ray, Blu-Ray R/RW, and HD DVD.
ODD Product means computers, video game consoles and ODDs that are designed to be attached externally to devices such as computers.
This action has now been certified. Please see Reasons for Judgment of Mr. Justice Masuhara pronounced May 13, 2016 below. The Judgement was upheld on appeal.
On May 16, 2019, the BC Court certified a settlement entered into with Philips & Lite-On Digital Solutions Corporation and Philips & Lite-On Digital Solutions USA, Inc. (“PLDS”).
The PLDS settlement (the “Settlement Agreement”) is subject to Court approval in Ontario, British Columbia and Quebec. Hearings to approve the Settlement Agreement will be held as follows:
