These proposed class actions allege the defendants and their senior executives participated in illegal and secret meetings and made agreements to fix the prices of Film and Electrolytic Capacitors sold in Canada, including British Columbia, and elsewhere. Copies of the notices of civil claim and their amendments can be viewed below. Proposed class actions have also been commenced in Ontario and Quebec.

Settlement Approval

On April 18, 2023, the BC Supreme Court certified for settlement purposes against:

  • ROHM Co., Ltd. and ROHM Semiconductor U.S.A., LLC (f/k/a ROHM Electronics U.S.A., LLC) (collectively “ROHM”);
  • Fujitsu Ltd. and Fujitsu Canada, Inc. (collectively “Fujitsu”);
  • KEMET Corporation and KEMET Electronics Corporation (collectively “KEMET”); and
  • Nichicon Corporation and Nichicon (America) Corporation (collectively “Nichicon” and together with ROHM, Fujitsu and KEMET, the “Settling Defendants”).

The settlement agreements with the Settling Defendants are subject to court approval in Ontario, British Columbia and Quebec. Hearings to approve the settlement agreements are currently scheduled to take place on:

  • Ontario: on September 28, 2023, at2:00 pm (EST), virtually.
  • British Columbia: on October 13, 2023 at 9:00 a.m., in-person at 800 Smithe Street, Vancouver, British Columbia; and
  • Quebec: on September 26, 2023 at 9:15 , in-person at 1, rue Notre-Dame Est, Montréal, Québec in room 15.04 and by virtual hearing at Liens TEAMS pour rejoindre les salles du Palais de justice de Montréal en matière commerciale, civile et familiale (coursuperieureduquebec.ca).

On August 1, 2023, the BC Supreme Court certified for settlement purposes against Nippon Chemi-Con Corporation and United Chemi-Con Corporation (“NCC/UCC”).
The settlement agreement with NCC/UCC is subject to court approval in Ontario, British Columbia and Quebec. Hearings to approve the settlement agreement are currently scheduled to take place on:

  • Ontario: on October 23, 2023, at 9:30 am (EST), virtually.
  • British Columbia: on October 25, 2023 at 9:00 a.m., virtually; and
  • Quebec: on September 26, 2023 at 9:15 am, in-person at 1, rue Notre-Dame Est, Montréal, Québec in room 15.04 and by virtual hearing at Liens TEAMS pour rejoindre les salles du Palais de justice de Montréal en matière commerciale, civile et familiale (coursuperieureduquebec.ca). This hearing will occur at the same time as the hearing for the settlements reached with ROHM, Fujitsu, KEMET and Nichicon.
