This proposed class action alleges that the defendants and their senior executives participated in illegal and secret meetings and made agreements to fix, raise, maintain, and control the price for the supply of Resistors and/or to enhance unreasonably the prices of Resistors and/or to lessen unduly competition in the sale of Resistors in Canada including British Columbia and elsewhere. The Notice of Civil Claim can be viewed below. Proposed class actions have also been commenced in Ontario and Quebec.
On July 22, 2021, the Ontario Court certified a settlement class regarding a settlement entered into with Kamaya Electric Co., Ltd. and Kamaya, Inc.. (collectively “Kamaya”). Kamaya is not a named defendant in the BC Action.
Kamaya has agreed to pay CAD $770,000 for the benefit of Settlement Class Members and to provide meaningful early co-operation to the plaintiffs in pursuing their claims against the non-settling defendants.
The Kamaya settlement (the “Kamaya Settlement Agreement”) is subject to Court approval in Ontario and Quebec. BC residents are included in the Ontario settlement class and should provide any comments or objections to the settlement to the Ontario Court. The court-ordered deadline for Settlement Class Members to opt-out of the Class Actions was January 29, 2021. If you did not previously opt-out, you are legally bound by the results of the Class Actions, including the Kamaya Settlement Agreement, if approved.

A settlement of CAD $2,350,000 has been reached with the Panasonic Corporation, Panasonic Corporation of North America, and Panasonic Canada Inc. (collectively “Panasonic”) defendants. The Panasonic settlement agreement was approved by the Courts in 2021.
If there are further recoveries, they will be added to the present settlement amounts and an efficient distribution will be made at an appropriate time. That plan must be approved by the Courts before it takes effect.
