CFL Class Action

The BC Claim

This proposed action was commenced in British Columbia (the “BC Claim”) by Mr. Bruce against the Canadian Football League (“CFL”), its teams, former commissioner and others on behalf of former CFL players who suffered concussion-related injuries while playing in the league (“Former Players”).
By Order of the Supreme Court of British Columbia dated March 11, 2016, the BC Claim was struck. Leave to the British Columbia Court of Appeal was dismissed on May 12, 2017. Mr. Bruce’s legal claims were directed to proceed by way of labour arbitration rather than through the courts.

The Ontario Class Action

On May 29, 2015, a proposed class action was commenced in Ontario by Mr. Banks against the CFL, its teams, former commissioner and others on behalf of Former Players.
On May 23, 2023, by Order of the Ontario Superior Court of Justice, the proposed class action has now been discontinued against all of the defendants.
Former Players who have suffered a concussion-related injury caused while playing in the CFL prior to October 31, 2023 can pursue claims through an agreed upon labour arbitration process. For more information on the arbitration process, please see the Short Form Notice. The arbitration deadline is April 30, 2024.
Important: if you know you suffered a concussion-related injury while playing in the CFL and you do not file a grievance by the April 30, 2024 deadline, you will not be entitled to file a claim at a later date.
