Court Approved Class Action Settlements

This litigation has now been resolved in its entirety. Court approved settlements were reached with all defendants, in a total amount of $48,276,500. Details regarding the settlements are set out below.

Philips and Samsung Settlements

A settlement agreement was reached with the defendants Koninklijke Philips Electronics N.V., Philips Electronics Industries (Taiwan) Ltd., Philips Electronics Industries, Ltd., Philips da Amazonia Industria Electronica Ltda., Philips Electronics North America Corporation and Philips Electronics Ltd (collectively “Phillips”) for the sum of CDN $12,396,500 in exchange for a full release of claims against them and their related entities, relating to the CRT Proceedings. The settlement represents a resolution of disputed claims. Philips does not admit any wrongdoing or liability.

A settlement agreement was reached with the defendants Samsung SDI Co., Ltd. (f/k/a Samsung Display Device Co.), Samsung SDI America, Inc., Samsung SDI Mexico S.A. de C.V., Tianjin Samsung SDI Co., Ltd, Shenzhen Samsung SDI Co. Ltd and Samsung SDI Brasil Ltda Samsung SDI (collectively “Samsung”) for the sum of CDN $16,980,000 in exchange for a full release of claims against them and their related entities, relating to the CRT Proceedings. The settlement represents a resolution of disputed claims. Samsung does not admit any wrongdoing or liability.

The settlement has been approved by the British Columbia, Ontario and Quebec Courts.

Toshiba, Hitachi and LG Settlements

A settlement agreement was reached with the defendants Toshiba Corporation, Toshiba America Electronic Components Inc., Toshiba America Information Systems Inc., Toshiba of Canada Limited (collectively “Toshiba”) for the sum of US $2,950,000 in exchange for a full release of claims against them and their related entities, relating to the CRT Proceedings. Toshiba has agreed to provide cooperation to the Plaintiffs in pursuing the CRT Proceedings against the remaining defendants. The settlement represents a resolution of disputed claims. Toshiba does not admit any wrongdoing or liability.

A settlement agreement was reached with the defendants Japan Display Inc., f/k/a Hitachi Displays Ltd., Hitachi Ltd., Hitachi Asia, Ltd., Hitachi America, Ltd., Hitachi Electric Devices (USA), Inc., and Hitachi Canada, Ltd. (collectively “Hitachi”) for the sum of US $2,050,000 in exchange for a full release of claims against them and their related entities, relating to the CRT Proceedings. Hitachi has agreed to provide cooperation to the Plaintiffs in pursuing the CRT Proceedings against the remaining defendants. The settlement represents a resolution of disputed claims. Hitachi does not admit any wrongdoing or liability.

A settlement agreement was reached with the defendants LG Electronics, Inc. LG Electronics Taiwan Taipei Co. Ltd., LG Electronics USA, Inc. and LG Electronics Canada (collectively “LG”) for the sum of US $7,750,000 in exchange for a full release of claims against them and their related entities, relating to the CRT Proceedings. LG has agreed to provide cooperation to the Plaintiffs in pursuing the CRT Proceedings against the remaining defendants. The settlement represents a resolution of disputed claims. LG does not admit any wrongdoing or liability.

The settlements have been approved by the British Columbia, Ontario and Quebec Courts.

Chunghwa Settlement

A settlement was reached with one of the defendants, Chunghwa Picture Tubes Ltd., Chunghwa Picture Tubes (Malyasia) Sdn. Bhd. and their related entities, including Tatung Company, Tatung Company America, Inc. and Tatung Co. of Canada Inc. Under the terms of the settlement agreement, Chunghwa has paid $2,000,000CDN for the benefit of the class members and is also obligated to cooperate with the plaintiff in the prosecution of the claims against the remaining defendants.  The settlement has been approved by the British Columbia, Ontario and Quebec Courts.

Panasonic Settlement

A settlement was reached with the defendants Panasonic Corporation (formerly known as Matsushita Electric Industrial Co. Ltd.) Panasonic Corporation of North America, Panasonic Canada Inc., and MT Picture Display Co., Ltd. (collectively “Panasonic”) for the sum of Cdn $4,150,000 in exchange for a full release of claims against them and their related entities, including Beijing Matsushita Color CRT Co., Ltd., relating to the CRT Proceedings. Panasonic has agreed to provide cooperation to the Plaintiffs in pursuing the CRT Proceedings against the remaining defendants. The settlement represents a resolution of disputed claims. Panasonic does not admit any wrongdoing or liability.

The settlement has been approved by the British Columbia, Ontario and Quebec courts.
