On April 24, 2017, CFM filed a proposed class action against FCA and Cummins alleging that illegal defeat devices were installed in certain diesel-powered Dodge RAM 2500 vehicles model years 2007 – 2012 and Dodge RAM 3500 vehicles model years 2007 – 2012.
The proposed class action alleges that the FCA defendants and the Cummins defendants equipped these vehicles with non-durable catalyst systems that cause the trucks to consume more fuel and emit levels of pollutants that are far higher than advertised and allowed by law. It is also alleged that these systems cause the catalytic converter to fail prematurely.
