SRAM Class Action – September 26, 2012 – Micron Settlement

A settlement has been reached with Micron Technology, Inc., Micron Semiconductor Products, Inc., and Micron Semiconductor Canada, Inc. (“Micron”).  A link to the settlement agreement is below.

This settlement must be approved by the courts of British Columbia, Ontario and Quebec. Dates for certification, notice of settlement hearing and settlement approval are being arranged with each of the courts as follows:

  • Ontario – hearing on certification for settlement purposes and notice of the settlement hearing was heard September 14, 2012; the hearing for settlement approval has not been scheduled yet
  • British Columbia – hearing on certification for settlement purposes and notice of settlement hearing is scheduled for November 1, 2012; the hearing for settlement approval has not been scheduled yet
  • Quebec – class counsel is working on obtaining a date from the coordinating judge of class actions.

If the courts approve the certification for settlement purposes, they will set a date by which all class members must opt out of the proceeding if they do not want to participate. This is a one time opt out date and is not limited to the settlement with the Micron defendants. Once the notices of settlement hearing have been approved by all of the courts they will be posted on this website and they will contain the date by which a decision to opt out must be made and how to communicate that decision.
