The Ontario court has certified this action for settlement purposes against three additional groups of defendants:

  • The Goldman Sachs Group, Inc., Goldman, Sachs & Co., Goldman Sachs Canada Inc. (collectively, “Goldman Sachs”);
  • JPMorgan Chase & Co., J.P. Morgan Bank Canada, J.P. Morgan Canada, JPMorgan Chase Bank National Association (collectively, “JPMorgan”); and
  • Citigroup Inc., Citibank, N.A., Citibank Canada, and Citigroup Global Markets Canada Inc. (collectively, “CITI”).

Vehicle Carriers – New Settlement

A Settlement Agreement has been reached with COMPANIA SUD AMERICANA DE VAPORES S.A. (“CSAV”). CSAV has agreed to pay CAD $450,000.00 for the benefit of Settlement Class Members and to provide co-operation to the Plaintiffs in pursuing their claims against the non-settling defendants. Air Cargo – claims information

Volkswagen – Proposed Settlement 2.0 Litre Vehicles

The Plaintiffs and Volkswagen have reached a proposed $2.1 billion settlement involving the 2.0-Litre Volkswagen and Audi TDI (diesel) vehicles that are alleged to contain “Defeat Devices.” The settlement is subject to court approval. Polyurethane Foam – FXI Settlement

The Courts in BC, Ontario and Quebec have now reached a settlement agreement with the FXI Defendants in the Foam actions.

On March 6, 2017, the plaintiffs will apply to the BC Court to approve the settlement agreement, a plan to distribute the settlement funds and class counsel fees of 25% of all settlement funds achieved plus taxes and case expenses.

Volkswagen – Notice Campaign

Starting on January 4, 2017, court-approved settlement hearing notices will be published in print and electronic media and sent to potential settlement class members by email from the court-appointed administrator – [email protected].

Settlements have been reached with the defendants in the following actions:

Automotive Wire Harness Systems:
Sumitomo Electric Industries, Ltd., SEWS Canada Ltd., Sumitomo Wiring Systems, Ltd., Sumitomo Electric Wiring Systems, Inc., Sumitomo Wiring Systems (U.S.A.), Inc., K & S Wiring Systems Inc., and Sumitomo Electric Wintec America, Inc. (“Sumitomo”) , in the amount of $10,700,000.
G.S. Electech, Inc., G.S.W. Manufacturing Inc. and G.S. Wiring Systems Inc. (“G.S. Electech”), in the amount of $120,000.

Members of Settlement Class B (purchases made between December 5, 2014 and November 2, 2016) may have an opportunity to opt-out of the action. Please review the Notice of Certification for Settlement Purposes and Settlement Approval Hearing here for more information.

Requests to opt-out of the proceedings must be post-marked by January 25, 2017.

Heater Control Panels:
Sumitomo Electric Industries, Ltd., SEWS Canada Ltd., Sumitomo Wiring Systems, Ltd., Sumitomo Electric Wiring Systems, Inc., Sumitomo Wiring Systems (U.S.A.), Inc., K & S Wiring Systems Inc. and Sumitomo Electric Wintec America, Inc. (“Sumitomo”), in the amount of $150,000.

Requests to opt-out of the proceedings must be post-marked by January 25, 2017.

Electronic Control Units:
Sumitomo Electric Industries, Ltd., SEWS Canada Ltd., Sumitomo Wiring Systems, Ltd., Sumitomo Electric Wiring Systems, Inc. and Sumitomo Wiring Systems (U.S.A.), Inc. (“Sumitomo”), in the amount of $150,000.

Requests to opt-out of the BC proceeding must be post-marked by January 30, 2017.

• The Sumitomo and G.S. Electech settlements are subject to court approval in Ontario, British Columbia and Quebec. Motions to approve the Sumitomo and G.S. Electech settlements will be heard in the Ontario Court in Toronto on December 19, 2016 at 10:00 a.m. in the Quebec Court in the City of Quebec on December 20, 2016 at 4:00 p.m. and the British Columbia Court in the City of Vancouver on January 3, 2017 at 9:00 a.m.

The settlement funds (plus interest, less court-approved fees and expenses) are being held in trust for the benefit of settlement class members. At a later date, the courts will be asked to approve a method of distributing the settlement funds to settlement class members.
