This proposed class action alleges that the defendants and their senior executives participated in illegal and secret meetings and made agreements to fix, raise, maintain, and control the price for the supply of Resistors and/or to enhance unreasonably the prices of Resistors and/or to lessen unduly competition in the sale of Resistors in Canada including British Columbia and elsewhere. The Notice of Civil Claim can be viewed in Documents. Proposed class actions have also been commenced in Ontario and Quebec.

Proposed Settlements

Two proposed settlements have been reached with the following defendants:

• KOA Corporation and KOA Speer Electronics, Inc. (collectively “KOA”) for CAD $3.3million; and
• Susumu Co., Ltd. and Susumu International (USA) Inc. (collectively “Susumu”) for CAD $90,000.

The KOA settlement is subject to court approval in British Columbia, Ontario, and Quebec. The Susumu settlement is subject to court approval in Ontario and Quebec. At these hearings, the Courts will determine whether the settlements are fair, reasonable, and in the best interests of the Settlement Class.

If the settlements are approved, the British Columbia, Ontario, and Quebec class actions will be resolved in their entirety.

The settlement hearings will take place at the following dates and times::

• Ontario Superior Court of Justice: on February 26, 2025 at 10:00 am by virtual hearing;
• British Columbia Supreme Court: on March 11, 2025 at 9:00am, in person at 800 Smithe Street, Vancouver, BC V6Z 2E1 (KOA only); and
• Superior Court of Quebec: on April 8, 2025 at 9:30am at 1, rue Notre-Dame Est, Montréal, Québec, Room 17.09 and by virtual hearing.

Opting Out of the Class Action

The court-ordered deadline for Settlement Class Members to opt-out of the Class Actions was January 29, 2021. If you did not previously opt-out, you are legally bound by the results of the Class Actions, including the KOA and Susumu Settlement Agreements, if approved.
