Contested Certification
On April 21-23, 2021, Class Counsel appeared before the Court to seek certification of the action against Jamieson Pharmaceuticals Ltd. (“Jamieson”), WN Pharmaceuticals Ltd. (“WN”) and Natural Factors Nutritional Products Limited (“Natural Factors”).
At that time, the plaintiff did not seek to certify the action against the defendant pharmacies and retailers.
On July 16, 2021, the Court granted the plaintiff’s request to certify the action against WN and Natural Factors but did not certify the case against Jamieson. The Court allowed the plaintiff to file supplemental evidence in support of her case against Jamieson.
On November 1, 2021, the Court granted the plaintiff’s request to certify the action against Jamieson as well.
WN, Natural Factos and Jamieson appealed the certification decisions. The appeals were heard on November 7, 2022.
On February 15, 2023, the Court of Appeal dismissed the appeals.
