The case alleges that the defendants (Live Nation Entertainment, Inc., Live Nation Worldwide, Inc., Ticketmaster Canada LP, Ticketmaster Canada Holdings ULC and Ticketmaster LLC) supply tickets to purchasers in Canada through websites such as www.ticketmaster.ca. The defendants collect service and handling fees on all event tickets purchased from www.ticketmaster.ca, including tickets resold on the secondary market through Ticketmaster Resale.
The case alleges that the defendants’ Terms of Use and Purchase Policy contain ticket limits on event tickets and prohibit the use of “bots” to ensure the fairness of the primary market. This action alleges the defendants are aware of and either turn a blind eye or facilitate professional ticket brokers’ ability to circumvent these rules. As a result, the plaintiff alleges that tickets are unfairly obtained on the primary market for resale, and prices on the secondary market have increased.
