This is an action to recover compensation for Indigenous persons who are serving a federal prison sentence or have served a federal prison sentence since April 17, 1985. The claim alleges that the way that CSC, administers the sentences of federal offenders adversely impacts and disadvantages Indigenous offenders and that this has contributed to the overrepresentation of Indigenous persons in federal custody. The claim alleges that CSC has systemically failed to provide access to culturally-informed correctional resources and Indigenous culture and spiritual practices, and has otherwise failed to take meaningful steps to address the inequality experienced by Indigenous offenders. The proposed class action brings claims in negligence and also seeks damages pursuant to s.24(1) of the Charter for breaches of s. 15 of the Charter.
