SRAM Class Action – November 21, 2012 – Courts Approve Certification and Publication re: Micron Settlement

The plaintiffs in the Ontario, British Columbia and Québec Actions have reached a settlement with Micron Technology, Inc., Micron Semiconductor Products, Inc., and Micron Semiconductor Canada, Inc. (“Micron”) subject to approval by the three courts. A link to the settlement agreement is below.

The Ontario, British Columbia and Québec courts have Certified and Authorized the actions as class proceedings as against Micron for settlement purposes only. The notice of Certification and Settlement Approval hearings may be viewed below:

The plaintiffs will now ask the courts to approve the Micron Settlement Agreement in the three jurisdictions and determine the amount to be paid to Class Counsel for fees and disbursements.

The dates for approval of the Micron Settlement Agreement are being arranged with each of the courts as follows:

  • Québec:                 February 4, 2013 at 11:00 a.m.
  • British Columbia: February 6, 2013 at 9:00 a.m.
  • Ontario:                 February 8, 2013 at 10:00 a.m.

Persons in Canada who purchased Static Random Access Memory (“SRAM”) or products which contained SRAM between January 1, 1988 and December 31, 2005 (the “Settlement Class”) who do not wish to participate in the actions or settlement are required to exclude themselves by opting out of the actions on or before February 13, 2013 in accordance with the procedure set by the courts as detailed in the Notice.

Members of the Settlement Class who wish to remain in the actions but wish to object to or comment on the Micron Settlement are required to send a written submission on or before January 25, 2013 in accordance with the procedure set by the courts as detailed in the Notice.
