As of September 23, 2024, the defendants have sought leave to appeal the Court of Appeal decision to the Supreme Court of Canada.
A settlement has been reached with Cathay Pacific Airways Ltd. Cathay has agreed to pay CDN $6 million and has agreed to cooperate with the Canadian plaintiffs in pursuing the claims against the remaining defendants. There is also a plan to distribute the money from the Cathay settlement and the previous settlements to class members. A motion to certify the actions as against Cathay, and to approve the Cathay settlement agreement, a plan to distribute settlement funds to class members and class counsel fees and disbursements is set to be heard before the Ontario, British Columbia and Quebec courts on July 4, 2016 at 10:15 am.
