This proposed class action alleges that the Defendants unlawfully abused the patent system in order to obtain exclusive monopoly rights in Canada to sell the medication Viagra. During the Class Period, the Defendants’ unlawful actions allowed them to overcharge purchasers of Viagra.

The action seeks to recover the overcharge that class members paid for Viagra during the period of January 1, 2006 to November 30, 2012.

The named defendants are:

  • Pfizer Canada Inc.
  • Pfizer Inc.
  • Pfizer Ireland Pharmaceuticals
  • Pfizer Research and Development Company N.V./S.A.

On August 5, 2014, the Supreme Court of British Columbia partially certified this class action. Mr. Justice Smith concluded that for the purposes of certification, the pleadings did disclose a cause of action. The Reasons for Judgement can be found below.

On September 4, 2014, the Defendants appealed the decision of the Supreme Court of British Columbia.

On December 8, 2015, the Court of Appeal for British Columbia allowed the Defendants appeal. The Reasons for Judgement can be found below.

On the February 8, 2016, the Plaintiff applied for leave to appeal to the Supreme Court of Canada. The application for leave is pending.
