This class action alleges that the Defendants unlawfully conspired to raise, maintain, fix, and/or stabilize prices at which Chocolate Products were sold in Canada, thereby lessening competition in the Canadian markets for these products. The term “Chocolate Products” refers to any and all chocolate confectionary products made by Cadbury, Hershey, Mars and Nestlé


Settlements have been reached with all defendants that resolve the litigation in its entirety. Each settlement has been approved by the BC, Ontario and Quebec courts.

Settlement Distribution

The BC, Ontario and Quebec courts have approved a protocol for distributing the settlement funds, plus accrued interest, less court approved legal fees and other expenses. The amount to be distributed totals approximately $17.3 million. A copy of the approved distribution protocol and the notice of claims process can be downloaded below.

If you bought Chocolate Products manufactured by Cadbury, Hershey, Mars or Nestlé in Canada between February 1, 2001 and December 31, 2008, you may be eligible to claim from the settlement funds. Consumer claims can be made without receipts or other documents.

To be eligible to claim, you must complete a claim form and file it by December 15, 2013.

Claims must be filed using the online claims process at www.chocolateclassaction.com. If you do not have Internet access, but wish to file a claim, please contact the claims administrator at 1-866-432-5534.

The courts have appointed NPT RicePoint Class Action Services (an independent third-party) to receive and review claims, make determinations in respect of entitlement to direct payment of settlement benefits, and issue payments to eligible Consumers and Commercial Purchasers.
