Air Transat Class Action

This class action was commenced against Air Transat on behalf of all passengers and related family members of passengers who were on Flight #236 which departed Toronto on August 23, 2001. The action is for damages sustained as the result of loss of fuel while airborne and the subsequent hard emergency landing of the aircraft.

On March 22, 2002, the Ontario Superior Court of Justice awarded carriage of a proposed class action suit on behalf of the passengers of Air Transat Flight #236 and their families to the legal team of CFM and the Ontario firm of Goodman and Carr LLP.

The Ontario Superior Court of Justice certified this class action in the summer of 2003 and in 2005, the Honourable Justice Cullity of the Ontario Superior Court of Justice approved the proposed settlement and distribution plan as submitted by class counsel. 

Class members' claims were assessed and funds have been distributed to the class members in accordance with the assessments.  This matter is now concluded.
