SURESTEP METER AND STRIPS CLASS ACTION

All persons in British Columbia who used a SureStep Meter or SureStep Strip on or after February 1, 1996.

A class action was commenced against Johnson & Johnson, the manufacturer of the SureStep Meter and Strips which are used by diabetics to measure their blood glucose levels. It is alleged that the following are defective:

  1. SureStep Meters manufactured before August 1, 1997 bearing a serial number in the series L6000 to L7205 or a serial number in the series L7206-GA-001 to L7206-GA- 01128,
  2. SureStep Strips manufactured before March 1, 1998 and distributed on or after February 1, 1996.

A similar action was commenced in the United States and a settlement was reached in that action.

Parallel actions have been commenced by co-counsel in Ontario and Quebec.

The Ontario court certified the Ontario class action in 2004.  Following unsuccessful appeals to the Ontario Divisional Court and the Ontario Court of Appeal, the defendants have sought leave to appeal to the Supreme Court of Canada and were unsuccessful.

The parties in all three actions have agreed to a settlement of the actions, subject to court approval, in Ontario, British Columbia and Quebec. The details of the settlement are summarized in the Notice of the Settlement Approval Hearing which may be reviewed here: (English) (French).
